New investor-state dispute settlement provisions in the CETA

 

EU and Canada have agreed to amend the text of the CETA with new ISDS provisions. The amendment has been shaped out consistently with Cecilia Malmström’s idea regarding the specific international arbitration court announced last year. According to the text, a permanent Tribunal and an Appellate Tribunal will be established and the importance of the ‘multilateralization’ of this model in the future agreements is also highlighted.
