A ’Külügyi Műhely – Gyorselemzés sorozat’ a Külügyi Műhely Alapítvány 2018-ban alapított online, tudományos időszaki kiadványa. A kiadvány rendelkezik a hazai és nemzetközi tudományos életben elvárt követelményekkel: ISSN azonosító, Crossref DOI azonosító, MTID, OSZK EPA és MTA REAL repozitóriumban történő archiválás, szakmai lektorálás. Ezenfelül gondoskodunk a megjelent publikáció minél szélesebb körű népszerűsítéséről is, elsősorban a Külügyi Műhely Alapítvány közösségi felületein.

Children’s rights and related social-legal issues are becoming a quite complex and far-reaching agenda for the international community. The most concerning issues arisen as the phenomena of child poverty, child labor, other forms of deprivation, global violence against children, the situation of children living with disabilities or with special needs in care, the burning problems of juvenile delinquency needs a multidisciplinary approach to evaluate at theoretical and practical level.

The area of the children’s rights (as it has only appeared in the 1920s as a subject of matter of modern socio-legal and political discourse) is quite young does not exist as a separate branch of law. Children’s rights do not affect only various fields of law, including civil law, criminal law, criminology, family law or administrative law, but also transcend the scope of constitutional law and international law.

There is no single code of law for children’s rights. The main source is the UN Convention on the Rights of the Child adopted in 1989. The basic principle based on the human rights approach that has now become an unquestionable paradigm means that the child is entitled to all the rights as adults, since they are human beings. Indeed they are in need of particular protection and support as a result of their special socio-legal status and age, which has to be provided by their caretakers, and ultimately by the state, thereby children’s rights issues gaining understanding in a number of social and legal relations. Due to their vulnerability and their evolving capacities and as they are facing barriers to exercise of rights, children need more and more active state protection than usual. The area of children’s rights was able to gain for itself, through the motivation and intensive work of active social movements, that today an international convention ratified by virtually all states in the world recognizes the existence and protection of the rights of the child.

But where do we stand now in the 21st century in the field of children’s rights?

We are welcoming papers from various fields within legal studies, such as family (civil) law, constitutional law, administrative law or criminal law and related disciplines (such as criminology, etc.), international law, and jurisprudence.

Papers may focus, among others, on the following topics:

• COVID-19 and children’s rights (incl. questions of discrimination in education vs. vaccination, mental health of the families, questions of digital competences - accessibility of digital tools in remote-education vs. poverty)
• Limits of state / competences of families in parenting (incl. specialities of churches as maintainers of care institutions? - freedom of religion)
• New forms of families (incl. transnational families, same-sex couples and children)
• Constitutionalization of children's rights (children and children’s rights in constitutions)
• Children in conflict with the law (incl. challenges of child-friendly justice, questions of legal representation, questions of low / high minimum age of criminal responsibility, unaccompanied minors and migrant families in alien procedures, restorative justice)
• Situation of child participation (incl. right to assembly, e.g. Fridays For Future (FFF) demonstrations, children involved in decision-making processes)
• Violence against children (incl. online safety, child prostitution - trafficking, new forms of substance abuse, disciplines in parenting)
• Implementation of children’s rights in cases of emergencies (incl. war situations)
• Children’s rights and climate change (incl. sustainable consumption, education, climate disasters)
• Questions related of development in biomedicine (incl. new issues related to human reproduction e.g. embryo donation, surrogacy, home birth, embryo research)

Kollégánkat, Kecskés Gábor tudományos munkatársunkat, a Jogtudományi Intézet kutatóját a Fiatal Kutatók Akadémiája két évre társelnökké választotta.

A Fiatal Kutatók Akadémiája a Magyar Tudományos Akadémia közfeladataival összhangban működő tudományos társaság, amely az MTA köztestületi tagságán belül alakulva, a fiatal kutatók hangja kíván lenni Magyarországon. Célja, hogy részt vegyen az MTA tudományos tevékenységében, itthon és külföldön képviselje a fiatal kutatók közösségét. Tevékenységével elő kívánja segíteni a fiatal kutatók szakmai fejlődését, valamint a kutatók és a társadalom közötti kapcsolat erősítését. Kecskés Gábor is e szellemben képzeli el társelnöki feladatait.

A Fiatal Kutatók Akadémiájában Kecskés Gáboron kívül Szalma Ivett (SZI) és Szentgáli-Tóth Boldizsár (JTI) vesz részt tagként a Társadalomtudományi Kutatóközpontból.

With challenges like rising nativism and a global pandemic, attention has focused on rebuilding economic and social infrastructure while ensuring equal access to benefits across racial and class divisions. Redistribution will require oversight and place strategic litigation in a crucial enforcement role. How litigation and courts will respond to this challenge is uncertain given recent institutional pressures on the European courts, which have arguably rendered them less potent in this particular moment, facing a backlash against the authority of supranational courts as well as an increasing mobilization in these courts for illiberal causes.

The practice and potential of strategic litigation cannot be fully appreciated without a threefold shift in analytical perspective. First, it is not possible to understand the meaning of strategic litigation in the European context without adopting a transnational perspective that illuminates two critical features of strategic litigation: (1) the way that it has traveled horizontally across borders, advanced by powerful global intermediaries and funders as a tool for facilitating political integration on the “Old Continent”, strengthening civil society, and thereby building the rule of law; and (2) the way that it operates vertically at the supranational level, engaging lawyers and social movement actors in claim making through national courts in order to create European precedents that bind domestic actors. Second, the study of strategic litigation requires new thinking about how law is produced from the bottom up: specifically, how law arises from the claims of marginalized social groups on the ground in member states, led by people who work with lawyers to actualize or protect their interests through legal channels. Third, we contend that appreciating strategic litigation requires an interdisciplinary perspective that incorporates insights into the cause and effect of litigation specifically, and legal mobilization more broadly, derived from law and social science research.

Aim of the call for application

Centre for Social Sciences Institute for Legal Studies (hereinafter: CSS ILS) and the Pázmány Péter Catholic University Faculty of Law and Political Sciences (hereinafter: Pázmány Law) have established a joint fellowship programme. This programme aims to enhance international competitiveness in research and education by involving a postdoctoral foreign researcher in Hungarian academic work. The programme is termed for a period of 10 months.

Eligibility criteria

The candidate is expected to be a postdoctoral researcher (PhD in law) proficient in English, with special focus on legal and administrative terminology. Knowledge of Hungarian is no requirement.

Furthermore, the applicant is expected to:

• draft and deliver 2 x 2 (= 2 x 90 minutes) graduate level lectures per week;
• to be present in the CSS ILS from 9 AM to 5 PM on Tuesdays and Thursdays;
• take an active part in the relevant multicultural academic events and programmes of CSS ILS and Pázmány Law, respectively;
• assist and strengthen the international relations of CSS ILS and Pázmány Law, respectively.

Research and teaching topics

Whereas any area of law is accepted in the application, with a preference to comparative law, public international law or European law, the following topics are expressly recommended to the applicants’ consideration:

• grants a gross mensual salary of 842,800 HUF before tax payment. This amount consists of three components: salary of a research fellow at CSS ILS, salary of an assistant professor at Pázmány Law and remuneration for the 2 x 2 graduate lectures;
• provides the opportunity to take active part in the academic work, events and programmes of the host institutions.
